Hesnet Terms of Service governs your use of all of Shaare Technologies LLC’s Brands, Products and Services, collectively called “Hesnet Services” or the “Services”, and all Digital Content including information, text, links, graphics, photos, audio, videos, etc uploaded, downloaded or appearing on Hesnet Services. By signing up for any of Hesnet Services you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Any new features or tools which are added to the current Services shall be also subject to these Terms of Service.
User Account Terms: Hesnet gives you a personal, worldwide, royalty-free, nonassignable and non-exclusive license to use Hesnet Services. You must read, agree with and accept all of the terms and conditions contained in this Terms of Service agreement, including Hesnet Services Privacy Policy before you become a Hesnet user. Hesnet Services are available for your use only if you are at least 13 years old and you are not a person barred from receiving services under the laws of the applicable jurisdiction.
To access and use the Services, you must register for a Hesnet account (“Account”) by providing your full legal name, current address, phone number, a valid email address, and any other information indicated as required. Hesnet may reject your application for an Account, or cancel an existing Account, for any reason, in our sole discretion.
All Users are issued a Personal Syd after registering for a Hesnet Account. Hesnet’s business to business B2Way Syd features would be available on Personal Syds for users who are 18 years and older. You must 18 years or older to register a Business for use of a Shaare Account. Persons below the age of 18 years are prohibited from registering a Business for the use of a Shaare Account, but they can be represented by a person who is 18 years old or older who will be responsible for the Account. Hesnet may use the email address you provide as the primary method for communication. You are responsible for keeping your password secure. Hesnet cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password. If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent, you must be authorized to do so.
Hesnet respects the intellectual property rights of others and expects users of the Services to do the same. Content alleged to be infringing on another party’s intellectual rights may be investigated with or without your participation and may be removed without prior notice.
General Use: You agree that when using Hesnet Services that Hesnet and its third-party providers and partners may place advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others. You must comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to: (a) Use the Services in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement; or (b) post or transmit any pornographic material; or (c) Solicit login information or access an account belonging to someone else; or (d) Attempt to gain unauthorized access to the Services or any networks, servers or computer systems connected to the Services, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.; or (e) Modify, adapt, translate or reverse engineer any part of the Services or re-format or frame any portion of the pages comprising the Services, save to the extent expressly permitted by these Terms or by law; or (f) Reproduce, duplicate, copy, sell, resell or exploit any portion of the Service;
Anonymous Settings: Users have the option to use special Shaare Technologies LLC Services anonymously. Where such services are used, Users are required to be over the age of 17 years. Abusive or objectionable content / communication will not be tolerated and may result in a deactivation of your anonymous account. (Hesnet is not to be held accountable for any abusive or objectionable content or communication.)
Warranty Disclaimers: TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, HESNET PROVIDES THE SERVICES “AS-IS” AND AS TO YOU DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NONINFRINGEMENT. HESNET DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM THE USE OF THE SERVICES. HESNET MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, FREE OF VIRUSES OR OTHER HARMFUL CODE, TIMELY, SECURE, OR ERROR-FREE.
Limitation of Liability: TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, (A) HESNET WILL NOT BE LIABLE TO YOU FOR ANY LOSS OF USE, LOST DATA, LOST PROFITS OR INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES RELATING TO THE USE OR INABILITY OF THE USE OF THE SERVICES, EVEN IF HESNET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND (B) HESNET’S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THE SOFTWARE AND THIS EULA, WHETHER IN CONTRACT OR TORT OR OTHERWISE, WILL AT ALL TIMES BE LIMITED TO FIFTY U.S. DOLLARS (U.S. $50). THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT.
Terminating or Deactivating your Account: You may terminate your Account with Hesnet at any time by deactivating your Account. Upon termination of the Services, the license granted hereunder will also be terminated. Hesnet can stop providing all or part of the Services to you if you violate the Terms and any other Hesnet Policies, or otherwise create risk or possible legal exposure for Hesnet. We will notify you by email or at the next time you attempt to access your account.
Terms of Service Revisions and Changes: This Terms of Service may be updated periodically to implement changes to our privacy practices or for other operational, legal, or regulatory purposes. If we modify these Terms, we will inform you of such changes by posting the revised Terms on Hesnet Services, and where these Terms are posted when using our other product and services. By continuing to access or use Hesnet Services, you agree to abide by the revised Terms.
